We take your privacy very seriously and comply with current data protection legislation.  We only store personal information that we need in order to manage cases effectively and safely and only keep it for as long as necessary.  If you contact us via the contact form or email, the details you provide will only be used to respond to your query and will not be passed to any third party. 

DATA PRIVACY NOTICE FOR SERVICE USERS

Talking Resolutions Ltd is committed to protecting and respecting your privacy. This policy (together with our terms of use and any other documents referred to on it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

 

The rules on the processing of personal data are set out in the General Data Protection Regulation (GDPR).

Definitions

  • Data controller - A controller determines the purposes and means of processing personal data.

  • Data processor - A processor is responsible for processing personal data on behalf of a controller.

  • Data subject – A person

  • Categories of data: Personal data and special categories of personal data.

  • Personal data - The GDPR applies to ‘personal data’ meaning any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier (as explained in Article 6 of GDPR). For example name, passport number, home address or private email address. Online identifiers include IP addresses and cookies.

  • Special categories of personal data - The GDPR refers to sensitive personal data as ‘special categories of personal data’ (as explained in Article 9 of GDPR). The special categories specifically include genetic data, and biometric data where processed to uniquely identify an individual. Other examples include racial and ethnic origin, sexual orientation, health data, trade union membership, political opinions, religious or philosophical beliefs.

  • Processing - means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

  • Third party - means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

The purpose(s) of processing your personal data

 

We use your personal data for the following purposes:

  • To contact you in relation to your case

  • To manage your case in a safe and appropriate way.

 

The categories of personal data concerned

 

With reference to the categories of personal data described in the definitions section, we may process the following categories of data of service users, where appropriate:

  • Personal data: Name, address, telephone number, email address, an outline of the types of concerns within the conflict or coaching situation.

  • Special categories of data: Any risk to personnel that has been identified by previous services that have had contact with you and any health information that is relevant to someone's ability to engage with our services effectively. We obtain your personal data from the organisation(s) that referred your case or are currently involved in helping you, or from you directly.

 

Our legal basis for processing your personal data 

 

  • Consent of the data subject: For the purposes of delivering services as requested by the individual. Evidence of consent is collected via Talking Resolutions referral forms that are completed by the referring organisation.

  • Processing necessary for the purposes of the legitimate interests of the data controller or a third party, except where such interests are overridden by the interests or fundamental rights or freedoms of the data subject. Data is processed for the sole purposes of offering service to individual(s), as requested by the referring organisation, after permission has been sought for details to be provided to us.

 

Our legal basis for processing special categories of personal data (article 9 of GDPR) 

 

  • Explicit consent of the data subject. Data is processed for the purposes of delivering conflict resolution services that are safe for both the parties and the professionals involved. Consent is sought by the referring organisation or provided by the service user directly.

Sharing your personal data

 

Your personal data will be treated as strictly confidential and will be shared only with the referring organisation, where necessary, for subsequent management of your conflict or coaching situation. If, during the time we are working with you, we are made aware of any illegal activity or we feel a person’s welfare is at risk we will make a disclosure to a relevant authority.

 

How long do we keep your personal data?

 

We keep your personal data for no longer than is reasonably necessary. Our document retention processes are as follows:

  • Mediation casefiles - for a period of three months after service has concluded. This reflects the timescale within which we may reopen your case if you require further assistance without the need for a new referral to be submitted. If a complaint has been made about the service you received, your case file will be retained for two years from case closure to enable us to respond adequately to any legal claims.

  • Mediation agreements – these will be deleted along with the mediation casefile.

  • Coaching casefiles – we will keep a copy of the personal information provided to us along with any notes taken for a period of three months after coaching has concluded. This will enable you to contact us for any clarification of the discussions during that period and allow us to respond adequately to any complaints.

 

Providing us with your personal data

 

We require your personal data in order to provide you with an appropriate, fair and effective service.

 

Your rights and your personal data

 

Unless subject to an exemption under the GDPR, you have the following rights with respect to your personal data:

  • The right to request a copy of the personal data which we hold about you;

  • The right to request that we correct any personal data if it is found to be inaccurate or out of date;

  • The right to request your personal data is erased where it is no longer necessary to retain such data;

  • The right to withdraw your consent to the processing at any time, where consent was the lawful basis for processing the data;

  • The right to request that we provide you with your personal data and where possible, to transmit that data directly to another data controller, (known as the right to data portability), (where applicable i.e. where the processing is based on consent or is necessary for the performance of a contract with the data subject and where the data controller processes the data by automated means);

  • The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction is placed on further processing;

  • The right to object to the processing of personal data, (where applicable i.e. where processing is based on legitimate interests (or the performance of a task in the public interest/exercise of official authority); direct marketing and processing for the purposes of scientific/historical research and statistics).

If we wish to use your personal data for a new purpose, not covered by this Data Privacy Notice, we will provide you with a new notice explaining this new use prior to commencing the processing and setting out the relevant purposes and processing conditions.

The information we collect on our website

We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet Protocol (IP) address used to connect your computer to the Internet; login; e-mail address; site password; computer and connection information. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); comments, feedback, product reviews, recommendations, and personal profile.

How we collect the information

When you conduct a transaction on our website, as part of the process, we collect the personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.  

We will also collect your name and email address if you opt in to receive newsletters.

Why we collect information on our website

We collect such Non-personal and Personal Information for the following purposes:

  1. To provide and operate the Services;

  2. To provide our Users with ongoing customer assistance;

  3. To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;

  4. To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services;

Our company website is hosted on the Wix.com platform. Wix.com provides us with an online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases, and general Wix.com applications. They store your data on secure servers behind a firewall. 
 

We will never share your personal data with any other third parties outside of those required, as mentioned above, to fulfill the services you request.
